High Court Declines To Compel The University of Nairobi To Allow Senator Mithika Linturi Graduate

Meru Senator Mithika Linturi will not be participating in the University of Nairobi graduation ceremony on Friday after the High Court declined to compel the institution to add him to the list.

Senator Linturi had moved to court on December 11 to challenge the University’s decision to deregister him as a law student for allegedly presenting fake papers to get admission.

High Court Judge George Odunga in his ruling said that the lawmaker will not suffer any prejudice if orders are not granted at this stage.

He noted that Linturi had not convinced the court what irreparable damage he will suffer if he does not graduate.

Judge Odunga, however, directed all the parties involved to expedite the case.

The senator argues that he “learned through the media” that the University of Nairobi had deregistered him on November 30 for allegedly having faked a Degree from Dr. Babasaheb Ambedkar Marathwada University in India to get admitted to UoN.

According to the papers filed in court, Linturi said that he was admitted to the university on January 3, 2014, and was slated to graduate on December 22, 2017, with a Bachelor of Law Degree.

He dismissed the allegations as “political witch hunt” linking his political nemesis Milton Mugambi Imanyara and former Meru Governor Peter Munya to his woes.

He also accused the Ethics and Anti-Corruption Commission (EACC) of participating and taking over the “political witch hunt”.

“EACC had conclusively investigated the allegations that Linturi self-declaration forms for 2013 elections filed with IEBC were falsified, “Linturi said through his legal team led by lawyer Tom Ojienda.

He wanted the court to quash the university’s decision to deregister him as well as compel them to reinstate his name on the graduation list.

The case will be heard on February 20th next year.
