Jimmy Wanjigi Files Police Harassment Suit, Seeks Anticipatory Bail

Businessman Jimmy Wanjigi has filed a police harassment suit over the ongoing police operation at his Muthaiga home in Nairobi.

Wanjigi, together with his wife Irene Nzisa Wanjigi, sued the Inspector General of Police Joseph Boiet and Director of Public Prosecutions Keriako Tobiko in an application filed through Murumba & Awele Advocates.

In a certificate of urgency filed by lawyer Jackson Awele, the couple denied having knowledge of the cache of firearms discovered in their Malindi home.

“The applicants deny knowledge of the said cache and categorically state that the property wherein the same were discovered, if at all, does not belong to them or any of their associates or affiliates as reported or at all,” Wanjigi submitted.

The businessman also says in his suit that the DPP, through his officers without a court warrant, entered his Muthaiga home on account of a suspected criminal offense committed on his Malindi property.

“The raid has been concocted to embarrass and falsely accuse me and is meant to settle political scores,” he says through lawyer Jackson Awele.

He also said that the DPP had no legitimate grounds for searching his premises or preferring criminal charges against him.

Wanjigi further noted that he has been subjected to arbitrary threats by agents operating under instructions from the Inspector General.

“The applicant, in particular, has over the last three months been subjected to untold mental and psychological anguish as police officers have been intimidating, harassing him and trailing him, curtailing his freedom of movement and right to privacy,” read the statement.

He wants the court to restrain police from “further trespassing, breaking into or in any way interfering with” the private residence without a court order.

The couple are also reportedly seeking anticipatory bail on any arrests.

Government spokesperson Eric Kiraithe has, meanwhile, said the raid on Jimmy Wanjigi’s Muthaiga home is not politically motivated, but a clampdown on a “nefarious criminal”.

Speaking to journalists at the Kenyatta International Convention Centre (KICC) on Tuesday morning, Kiraithe said:

“The police are doing a very simple task, which is not politically motivated. The raid on Wanjigi’s home means we have a nefarious criminal in our midst, who has been uncovered, period.”

“The search launched on Wanjigi’s home is not by any means political… When you hear that illegal firearms have been recovered from anybody, it simply means that that person is a nefarious criminal who every law enforcement agency needs to go into overdrive. Any gun outside here in the wrong hands is a threat to the security of each and every Kenyan,” he added.
