Senator Moses Wetangula’s Bodyguard Charged Over Supreme Court Scuffle

A police constable also serving as Bungoma Senator Moses Wetangula’s bodyguard has been charged in a Nairobi court with resisting arrest and causing a disturbance.

Constable Simon Linyon on Monday found himself on the wrong side of the law when he tried to force himself into the Supreme Court on August 28, 2017, after he was barred from entering while armed.

He was in the company of NASA coalition leaders Raila Odinga and Moses Wetangula who demanded that the officer is allowed in the building since he was part of the senator’s security detail.

It is alleged that Wetangula’s bodyguard when stopped, created a disturbance by failing to obey lawful orders.

He is further accused of having resisted arrest and shoving his superior; Mr. Robinson Thuku, the OCPD Central Police Division Nairobi as well as other arresting officers.

Following the drama, Linyon was disarmed and placed under arrest before he was driven away to the Central Police Station.

Linyon on Wednesday appeared before Milimani chief magistrate Francis Andayi where he denied all the accusations against him. He was released on a Ksh 20,000 personal bond and was also directed to deposit his national identity card with the court.

The case will be heard on September 18, 2017.

Constable Simon Linyon has since been recalled from the senator’s security detail. Rumor has it that the accused officer has also been dismissed from the police service.

The Police have, however, refuted those claims saying that the constable is just facing his charges.

Senator Wetang’ula has demanded his bodyguard’s reinstatement as he called for due process to be followed.

The Supreme Court has meanwhile completed their hearing of the opposition’s challenge to the August 8 general election. Chief Justice David Maraga said after hearing the cases from both sides, said a ruling will be delivered on Friday.

The seven Supreme Court judges will now consider all the evidence before choosing to either swear-in Uhuru Kenyatta or order a re-run of the election.
